Terms & Definitions
- Site Visitor
- A person who came to the site overtheseadress.com without the purpose of placing an Order.
- User
- An individual, a Site visitor who accepts the terms of this Agreement and wants to place Orders in the online store overtheseadress.com.
- Buyer
- A person who accepted the public offer on the terms of this offer, placing orders and purchasing goods from OVERTHESEA LLC for their personal, household and other needs not related to business activities.
- Seller
- OVERTHESEA LLC, location Ukraine, Kyiv.
- Online Store
- The official online store of OVERTHESEA LLC located at overtheseadress.com, which presents the Products offered for purchase, as well as payment terms and delivery of Goods to Buyers.
- Website
- overtheseadress.com
- Product
- Clothing, shoes, accessories and other products offered for sale on the Site.
- Order
- A properly completed demand of the Buyer (filled in the appropriate fields on the website in the CART / CHECKOUT section) for the purchase and delivery of Products selected on the Website.
- Acceptance
- Acceptance of this Public Offer is considered to be the Buyer's execution of an order for Goods in accordance with the terms of the Public Offer.
1. Generalities
- The Seller sells Products through the online store at overtheseadress.com.
- By ordering Products through the online store, the User agrees to the terms of sale set out below. In case of disagreement with this Public Offer, the User must immediately stop using the service and leave the site.
- These terms of sale, as well as information about the Product presented on the Site, constitute a public offer in accordance with Article 641 and paragraphs 1–2 of the Civil Code of Ukraine. Consumer protection relations are regulated by the Civil Code of Ukraine and the Law "On Consumer Protection".
- The public offer may be changed by the Seller unilaterally without notifying the User/Buyer. The new version enters into force upon publication on the Site and applies to any Order made after that publication.

- The public offer is recognised as accepted from the moment the Buyer places an Order without authorisation on the Site, or accepts the Order through the ORDER FORM page in the CART section.
- The agreement concluded on the basis of the Buyer's acceptance of this offer is an accession agreement to which the Buyer joins without any exceptions or reservations.
- The fact of placing an order by the Buyer is an unconditional acceptance of the terms of this Agreement.
- The retail purchase and sale agreement is considered concluded from the moment the Seller issues the Buyer a cash or sales receipt or other document confirming payment.
- By providing their e-mail address and phone number, the Buyer consents to the use of these means of communication by the Seller and its engaged third parties for the purpose of fulfilling obligations, sending advertising and informational messages, transfer of the order for delivery, and other notifications directly related to this Public Offer.
- By placing an Order, the Buyer agrees that the Seller may assign the execution of the Contract to a third party, while remaining responsible for its execution.
- The Buyer can place an order at overtheseadress.com 24 hours a day, 7 days a week, except for periods of routine maintenance or technical failures.
- Addresses and operating hours of the pickup point, as well as return conditions, are available on the Site in the SHIPPING and RETURNS sections.
- All text and graphic content on the Site is the property of the Seller or its contractors. Viewing or printing pages is permitted for personal use only.
2. Subject
- The subject of this Public Offer is to allow the User to purchase Goods for personal, family, home and other non-business needs, presented in the catalog of the online store at overtheseadress.com.
- This Public Offer applies to all types of Goods and services presented on the Site, as long as such offers with descriptions are present in the online store catalog.
3. Product & Purchase Order
- Registration on the Site is not mandatory for placing an Order.
- The Seller is not responsible for the accuracy and correctness of the information provided by the User when ordering.
- Communication between the User/Buyer and Seller representatives must be based on the principles of generally accepted morality and communication etiquette. Obscene language, offensive expressions, threats and blackmail are strictly forbidden.
- If ordered Goods are not available in the Seller's warehouse, the Seller has the right to exclude the specified Product from the Order or cancel the Order, notifying the Buyer by e-mail. Product images are illustrative and may differ from the actual appearance. Descriptions may contain typos. For clarification, the Buyer should contact the Seller via the CONTACTS section.
- In case of cancellation of a fully prepaid Order, the cost of the cancelled Product is returned to the Buyer in the same manner as the payment was made.
- The Buyer's order is made in accordance with the procedures specified on the Website in the CART section.
- The Buyer is fully responsible for providing incorrect information that resulted in the Seller's inability to properly fulfill its obligations.
- After placing an Order, the Buyer receives information about the expected delivery date by e-mail or phone. The manager serving the Order clarifies its details, agrees on the delivery date depending on the chosen delivery method, availability of goods in the warehouse, and the time required for processing and delivery.
- The delivery date may be changed unilaterally by the Seller if there are objective reasons, in the Seller's opinion.
